first up we're waiting on the start of the white house briefing expected any minute route now, we should get fresh reaction to the clock ticking so loudly in washington today. midnight, when the department of homeland security will run out of money, unless congress does something about it. because they never let anything go right down to the wire and car reen towards a crisis with minutes to spare, ever. over an hour ago the senate passed a clean bill through september.

the house spent different measure, for three weeks of the nancy pelosi said this minutes ago. >> house republicans instead have continued to manufacturer a crisis that does not exist but exacerbate the insecurity of our country. >> joining me from washington, nbc news capitol hill correspondent kelly o'donnell. there's been question about what house democrats are going to do. >> nancy pelosi and her team are encouraging democrats not to ensure a short term suggestion. democrats would have preferred to see a funding bill that would carry the department through the end of the fiscal year without any attachments that would derail plans for immigration. so this is a move kind of a protest in a way to say that republicans have to live with this issue because they have not been un -- they have been

unwilling to reach some sort of compromise republicans will say it's the democrats who haven't been willing to compromise. but where we are right now on this final day of this drama, only perhaps hit the reset button and get another three weeks to repeat this again is that the senate has acted and a number of democrats, three from red states which is somewhat unusual, went along with republicans. there could have been more so that's interesting to say that they wanted to support the two-part plan if you will the funding of the department through the rest of the year and then that second piece where three democrats came is a long with republicans on the piece that would have undercut the president's executive action. so the senate has done its work. we're in sort of a holding pattern on that side of the capitol. attention on the house. can they get the three-week extension through and it will be up to mitch mcconnell to push it across the finish line which is expected. but until it happens, every step

>> reporter: it was a fairly gradual process and took place over several years, if you believe his defenders, they say that jihadi john mohammed emwazi, who spent almost all of his life growing up in london that he was a victim according to some of his associates. they say he was constantly harassed by british intelligence and denied the ability to travel outside the country on more than one occasion. he couldn't leave because he was on no fly lists. and that he tried to be recruited to work for mi5 for british intelligence. and the harassment is what drove him to hate his home country and hate the west and embark down this path. there's another way of looking at it that the british intelligence services were watching him because he was associated with extremist groups that he had been long associate

with al qaeda linked groups particularly al shabab in somalia and that is why they were watching him, not the other way around. the fact remains they were watching him. they did twice deny him the ability to fly. he was on a no fly list. he and his family were in contact with british law enforcement agencies reportedly 12 different times. so he had quite a big file in the u.k, yet somehow he managed to slip under the radar, get out of the country and end up in syria where he put on his mask and became the spokesman and executioner who -- still called jihadi john but who now has been identified. >> incredibly troubling story and richard engel, always a pleasure and learning experience watching you -- >> before you go ronan, before you go. i wanted to say, i think i was

applause line rhetoric we just played through from the previous speakers. that's partly because bush has not shown himself to be particularly strong in the prepared speech behind a podium way of going about things. instead he much preferred to have the more casual looser conversation one on one with the moderator. the question is going to be how difficult are the questions that come at him from sean hannity. senator ted cruz had pretty easy questions, why does ted cruz love america. i'm interested to know if jeb bush will have to field that same -- this has not been the friendliest room for him so far. chris christie took a jab at him, insinuated he was an elitist and laura ingram the radio host got up and asked the crowd how many of you are skeptical of a third bush and most cheered loudly. it's going to be an interesting

test. >> seems like a party atmosphere. >> if you like country music, we have a party going. >> we'll check back with you later when jeb bush does those remarks. with the nomination of his chosen successor loretta lynch moving forward, eric holder could leave office very soon. attorney general holder just sat down for an exit interview with pete williams and spoke about the announcement that it would not pursue federal charges in the trayvon martin case. >> a young man lost his life for no good reason. the fact that no one essentially was held accountable made that decision difficult. but i think it was the right decision given the high standard that we have to meet in trying to enforce the federal self-rights laws. >> joining me from washington the great pete williams. you also spoke about the federal

civil rights laws in general that he looked at over his tenure. what did you learn from that conversation? >> based on what they said about the trayvon martin case couldn't meet the standard of this in the law and i asked him whether he thought the standard in the law was too high. he said, yes and he thinks it should be changed. here's what he said. >> we do need to change the law that i think the standard is too high, that there is a better way in which we can have federal involvement in these kinds of matters to allow the federal government to be a better backstop in examining these cases. i think there probably needs to be a change with regard to the required standard of proof. >> and he said within the next few days he's going to make more of a public presentation about this and urged for a change, perhaps a change that would require congressional action. now a member of the senate judiciary committee has already said he thinks the law should not be changed.

we report on mostly terrifying things terrorist attacks and kris jenner none of those things come close to the massive terrifying mysteries of space, scientists have discovered a monday terrorster black hole. it's at the center of our radiation source that puts out a million billion times more energy than the sun. black holes are insanely dense. nasa suggests when you think of black holes you should envision a star ten times more massive than the sun squashed into an area of size of new york. the result is a field so strong that not even light can escape. luckily this particularly black hole is 13 billion light years away. the one and only bill nye, a pleasure to have you on. we're dealing with fictional space news that is very sad,

allyally son, what's your reaction to the comments? >> i'm very encouraged to hear -- to hear secretary carter's values come up here. the recognition that nothing she prevebt a transgender person from serving other than their qualifications to serve. i'll tell you what i think what's even more important here is not his response to the question but where the question came from. this came from an actively serving navy officer who happened to be in the audience adding his voice to that of other officers and military officials who are asking why haven't we fixed this yet. >> landon some have criticized this statement for using this phrase, personal lives and proclivities, the "new york times" called it unfortunate. i want to be careful about calling out an off the cuff choice of words, do you have any reservations about the words he used? >> when it comes down to semantics, i don't think that's

what we should focus on. he's in support of a policy that harms and discriminates against 15,500 actively serving military service members and that's where our focus needs to be. >> allison, how do you turn this talk into action? >> that's a really great question. i think that we have a role to play, those of us who are working with the pentagon from the outside and who are transjendser veterans. the problem that the pentagon faces is not just that they have this policy that is obsolete and completely out of touch with current medical knowledge and so forth, but they also don't have the internal expertise to fix it. that's where we see a role for people like us who have serve and understand how the military works, who also understand transgender people and their lives. >> there are 15,000 by one estimate still serving in silence because of their transgender status. landon, having been through this experience yourself and having been discharged because of this

ongoing ban. what's your message to those still serving in silence? >> it's getting better. i think we're seeing more change than we ever anticipated, even a year ago. and i know it's hard. it's a burden that nobody should have to serve under but times are changing and i look forward to the day that open service is happening and it's -- no longer in question or no longer damaging careers and families and military members lives. >> secretary hagel promised some kind of review or expressed openness to a review last year. what has the hold up been? what is the main reservation still outstanding on this? >> when you've asked me that question in the past i said that the problem is lack of leadership in the office of secretary of defense. it took secretary hagel months to get to the point of making the statement that he made. secretary carter has now moved beyond that and he said he believes transgender people should be allowed to serve, nothing should preclude them but their qualifications to serve.

and he's been in the office for just about two weeks. i look forward to seeing him take the next steps and actually order a comprehensive top-down review of these obsolete policies. >> and landon as someone who has come face to face with the consequences of these policies, what would your message be to the new secretary? >> any policy that's in place that's harming our american heroes is a policy that needs to change quickly. as long as we have a military we'll have members in it and some members will be trans transgender. it's time we step up and do better for our troops. >> allison robinson and landon wilson thank you both for your service. >> thank you ronan, honor to be here. >> up next impunity bill cosby performing again tonight and saying the show will go on. as another woman comes through with another abuse allegation a lawyer inside one of these cases next.

hey, hey, hey, i'm far from finished, that's what bill cosby is saying about his career. even as reports swirl today of dwret another accuser coming forward with yet another charge that cosby drugged and sexually assaulted her. in total, more than 30 women have now come forward with allegations that they were drugged or assaulted by the comedian. i spoke to one of those accusers janice did inson and she told me she thinks cosby shouldn't be working anymore. >> are there still people working with bill cosby? i don't know if you want to hire this guy, you're making a big mistake. bill cosby should not work anymore. he shouldn't be in front of an audience. >> working he is. the presumption of innocence is of crucial importance in this

court of law. cosby himself denied past allegations and hasn't been charged with a crime. would be in the court of public opinion and in the court of public opinion in the entakenment industry specifically lisa bloom represents janice dickinson and has been an advocate for many survivors of sexual assault. this is an incredibly tough case where you have a powerful man not convicted, does it fall on the entertainment industry to create accountability? >> the presumption of innocence applies in court, criminal courts but the irony is people like janice who i represent and many others can't get into court to prove their case because of the statutes of limitations. really bill cosby is given a pass by many people because he hasn't been convicted but nobody can get in the courthouse door to prove the case. >> almost every statement from his legal team what does it say

about the industry that this is a matter of public conversation for so long without it blowing up in his face? >> i think it says that rich and powerful people get a pass. i see this every day in my own practice because as you say, i represent many victims of wealthy and successful predators. the first thing they do is go on the attack against the victim try to dredge up anything from her life that they can find to embarrass her. who amongst us once you've reached middle age or other, doesn't have some embarrassing thing, a bankruptcy or criminal conviction or somebody says we did them wrong. women are smeared or threatened they will be smeared eded if they come forward. some of his accusers did go to police and the police refused to prosecute her case. recently here in l.a. another young cosby accuser went to the police and they refused to prosecute. so it's very very difficult for women. the men have all of the power. >> as some in the audience may know, i've seen these issues in

my own family and one thing that makes it so hard the shear scale of resources that men in hollywood have and that vastly outstrips the accusers. cosby has a prominent lawyer and powerful p.r. machine. >> what if someone raped your wife marty, you've got daughters, marty. what if bill cosby came and drugged their innocence, marty? how do you like me now, marty? that's what i say. >> lisa with the kinds of resources available to someone of cosby's stat tour can the women get a fair hearing in the court of public opinion? >> they need an attorney, even just in the court of public opinion so they don't get further maligned. reason why janice was so angry in that clip is because bill cosby's attorney marty singer came out and called her a liar. she's been revictimized not only

does she allege she was raped and drugged by bill cosby but something she told in 2001 or 2002 before any other women made this announcement but they are coming out and calling her a liar. she wants the ability to prove she's telling the truth. bill cosby, let's go in front of a retired judge or waive the statute of limitations and let janice prove her case. you can assert your defenses and we'll see what the court says as to who's lying or not. >> some celebrities whoopi goldbergs and others have come forward to support cosby. eddie murphy declined to make fun of him during the anniversary special. what is the proper role of industry colleagues in a case like this? should they stand up for the women? is that their job. >> we have to be realistic. if it were one accuser or two, we would have questions. when we have by my count 37 women who did not know each other across the country and decades what make strikingly

similar allegations it's time to get real and acknowledge that even if half were telling the truth, a serial sexual predator. he should not be hired and people should not go to his shows. i think we have to recognize the reality of what we're dealing with here. >> but there are still scores of fans turning out for those shows and that will likely be the case tonight. we'll watch for that. this snts an isolated case either steven collins has high accusations against him and gloria allred is representing one of those accusers. a lot of striking similarities, is there a culture of i am punitive in hollywood? >> yes, i would add if you see a bill cosby show, you may be paying for him to make jokes about the rape allegations against him. he made one at a recent show. where are you going? she said i'm going to get say drink. you better not have drinks around me, ha ha ha those ticket sales are going to support those kinds of demeaning comments about his accusers. >> is there a risk though that the media goes too far in

talking about these accusations given the lack of a conviction? where should the line of caution be drawn? >> i certainly think that the media has a responsibility to vet these stories, to vet any stories, we don't just take an accusation as true in the media or in court or anywhere else. you want to look for corroborating evidence as i said with janice she's been making these allegations for a very long time and look for kroks. if you have other people making strikingly similar allegations, i think that establishes corroboration. >> what would you say to other women in the same situation as some of these accusers coming forward? for the next case of this type what's your message to them? >> i would say get an attorney who's going to represent you aggressively immediately and go to the police. we really have to go to the police. i understand all of the reasons why we don't and we have to follow up with police. i as a private attorney for a lot of people have to follow-up with the police and put together evidence packets for them because they are reluctant
